In the Federal Register today, the FAR Council issued an interim rule with immediate effect that will provide significant benefits to small businesses that provide products and services to the federal government. Pursuant to Section 1331 of the Small Business Jobs Act of 2010, the FAR has been changed to provide for small business set-asides for orders under multiple award contracts including under the Federal Supply Schedule program. This means that government contracting officers may now at their discretion limit competition for orders under such contracts solely for small businesses or types of small businesses. As the interim rule indicates, "This rule may have a significant positive economic impact on any small business entity that wishes to participate in the Federal procurement arena."
